TERMS AND CONDITIONS OF SALE AND REDEMPTION OF STAY GIFT VOUCHERS

I. GENERAL TERMS

Zalesie Mazury Active Spa offers stay/gift vouchers purchased by customers as presents for third parties.

  1. Zalesie Mazury, hereinafter referred to as the Issuer, undertakes to sell a gift/stay voucher to the Purchaser (on site at Zalesie Mazury Reception, via INPOST courier or by email) and to accept it for redemption at Zalesie Mazury, Zalesie 12, 11-010 Barczewo.

  2. The Issuer is not responsible for non-delivery of the voucher by INPOST or due to any causes not attributable to Zalesie Mazury.

  3. The Purchaser agrees to pay the amount corresponding to the nominal value of the voucher. The voucher is issued only after the funds have been credited to the Zalesie Mazury account and is dispatched within 3 working days in case of an individual order.

  4. The voucher can only be redeemed after making a reservation and receiving confirmation via email from the Reception (recepcja@zalesiemazury.pl; tel. +48 606 30 63 44).

  5. The voucher may be used at Zalesie Mazury as specified in its contents or up to the amount stated on the voucher for purchasing goods or services.

  6. The user redeeming the voucher must present the original voucher at the registration process at Zalesie Mazury Reception. Upon presentation, the user is entitled to the ordered product or service. If the original voucher is not presented or is invalid (e.g., expired), the Issuer reserves the right to refuse service based on such a voucher.

  7. The voucher is non-refundable, non-exchangeable for cash, and must be used in full in a single transaction.

  8. Zalesie Mazury is not responsible for lost, damaged, or expired vouchers after they have been handed over to the Purchaser/User.

  9. The validity period is indicated on the voucher and shall not exceed 12 months from the purchase date.

  10. The Purchaser/User has no claims against Zalesie Mazury in case of loss (theft), destruction, or non-use of the voucher within its validity period (e.g., refund request). In exceptional circumstances, during the validity period, the Purchaser/User may request in writing to extend the validity for up to 3 months. A negative decision does not give rise to any claim.

II. RULES FOR USING VOUCHERS

  1. Zalesie Mazury accepts only vouchers that are undamaged, bear a validity date, stamp, and signature of the Issuer. Exceptions apply to vouchers purchased electronically via the Issuer’s website.

  2. No refund of the unused balance will be granted if the value of the service is lower than the voucher’s value.

  3. If the service value exceeds the voucher value or if the service is not fully covered by the voucher, the user is obliged to pay the difference in cash or by card on site.

  4. Zalesie Mazury reserves the right to refuse vouchers that are expired or damaged to the extent that the data cannot be read.

  5. Reservations based on vouchers are non-refundable and cannot be changed free of charge within 14 days prior to the planned stay.

III. PAYMENTS AND COMPLAINTS

  1. The purchaser receives a VAT invoice at the moment of purchase.

  2. All complaints related to the use of the voucher will be considered upon written submission by the Purchaser or User.

  3. A VAT invoice issued at the time of voucher purchase is required as a basis for processing complaints.

IV. FINAL PROVISIONS

  1. By receiving the voucher, the Purchaser/User confirms that they have read and accepted these terms and will comply with them. Every voucher user is required to comply with all regulations in force at Zalesie Mazury.

  2. Redeeming a voucher constitutes confirmation of the order under these terms.

  3. These Terms and Conditions are available at www.zalesiemazury.pl and at the hotel reception. The Issuer is obliged to make them available on request.

  4. The Issuer reserves the right to amend the regulations provided that it does not violate the rights already acquired by Purchasers/Users. All changes will be updated on the Issuer’s website and made available at the reception.

  5. For matters not covered in these terms, the provisions of the Polish Civil Code shall apply.

V. PERSONAL DATA PROCESSING

  1. Providing data is voluntary and necessary for voucher purchase and redemption. Failure to provide data prevents voucher processing. Data is processed for voucher execution and potential claims handling.

  2. Data is stored for the duration of the agreement and for 2 years after voucher use. If processed for accounting, data is stored for 5 years from the end of the tax year.

  3. The Purchaser/User has the right to access, rectify, delete, restrict, or transfer their personal data, as well as file a complaint with the supervisory authority and withdraw consent at any time.

  4. The Purchaser/User has the right to object to processing based on the legitimate interest of the administrator or previous consent.

  5. The Administrator processes only the data of the voucher purchaser. They are not authorized to process third-party data (voucher holder) due to lack of consent.

  6. Vouchers for third parties are issued in bearer form.

  7. The Administrator is not authorized to send/deliver the voucher to the third-party recipient.
